Terms of service

These terms cover BuyWise: the browser extension, the website at buywise.fyi and, when they are available, the API at api.buywise.fyi and the connectors that let AI assistants such as ChatGPT, Claude and Muse use BuyWise (together, "the service"). The service is run by Mitchell Kucy, a sole proprietor in Washington State, USA, doing business as BuyWise ("we", "us"). By using the service you agree to these terms. Our privacy policy explains how we handle data. You must be at least 18, or the age of majority where you live, to buy Pro.

1. What BuyWise does, and what it doesn't

BuyWise gives signals about products, brands and sellers: AI-generated estimates about things like generic rebranded products, quality, price, discounts, reviews and sellers, each with a confidence.

• Signals, not advice. BuyWise never tells you to buy or not buy. Signals can be wrong or out of date, and they are not professional, financial, legal or safety advice. You decide what to buy.
• No affiliation. BuyWise is not affiliated with or endorsed by the stores, brands or sellers it reports on, they don't pay for its results, and it shows no ads or affiliate links. Their names and trademarks belong to them and are used only to identify them.
• Not on every site. BuyWise refuses to check pages on banking, payment, health, government, email, messaging and sign-in sites it recognizes, and may decline other pages.

2. Using it through an AI assistant

When you use BuyWise inside ChatGPT, Claude, Muse or another assistant, that assistant decides when to ask BuyWise and how to use the answer, and its own terms and privacy policy also apply. We're not responsible for what the assistant does or says, including how it summarizes our signals.

3. License keys and API keys

• Keep your license key and any API key private; treat them like passwords. You're responsible for use of your keys, including use by assistants or apps you connect.
• Your license key also opens your account at buywise.fyi/account, where you can see your plan, make and revoke API keys, and manage or cancel Pro.
• A Pro license works on up to 5 installs at a time, including Chrome browsers that pick up your key automatically through Chrome sync. When you add more, the install linked longest ago is unlinked. A key can be added to at most 10 new installs a day.
• Tell us at support@buywise.fyi if you think a key has been misused, and we'll help secure your account.

4. Free, Pro and billing

• Free. Free use includes a limited number of checks a day, in the extension and through the API or an AI assistant. The limit may change.
• Pro. Pro isn't on sale right now. This section covers existing subscriptions, and Pro once it's on sale again. Pro costs $2.99/month plus any applicable taxes, charged in US dollars to the payment method you subscribe with through our payment processor, Stripe: when you subscribe, and then on the same day each month (or the last day of a shorter month). You can buy Pro on our website at buywise.fyi/pro, through an AI assistant that offers it (it gives you a checkout link, and you open it and pay yourself), or in the extension. Pro includes 3,000 checks in each billing month, shared by every install and API key on your license. Unused checks don't carry over, and when they're used up BuyWise stops checking until your next billing month starts. Pro is for personal shopping: unusually heavy use in one day, on one license or one API key, may be paused until midnight UTC.
• What counts as a check. Each page you check in the extension, including a re-check, and each brand or listing checked through the API or an AI assistant counts as one check.
• Automatic renewal. Pro is a monthly subscription that renews automatically until you cancel. Each month we charge the Pro price ($2.99/month) plus any applicable taxes to the payment method you subscribed with. There is no minimum term.
• Cancelling. You can cancel anytime online: at buywise.fyi/account, enter your license key and click Manage or cancel; or in the extension's settings, click Manage or cancel next to Subscription; then cancel on the billing page that opens. Or send us this cancellation email from the email address you subscribed with. Cancelling stops future charges; Pro stays active until the end of the billing month you've already paid for.
• No refunds. Payments are non-refundable, including for partial months, except where the law requires otherwise or if we end Pro (see section 9). We will refund a charge made in error, such as a duplicate charge or a charge made after you cancelled. If something isn't working or you have a question, email us at support@buywise.fyi and we'll help.
• If you live in the EU or UK. If the law where you live gives you 14 days to withdraw from an online purchase, email us within 14 days of subscribing and we'll cancel and refund that payment in full.
• Changes to price or plans. We'll email Pro subscribers 7 to 30 days before a price change applies to them, with how to cancel. You can cancel before it takes effect. We won't add a usage-based or other new charge to your subscription unless you agree to it first.

5. Fair use and the API

The free tier and the API have rate limits and daily limits, which may change. Don't:

• try to copy, scrape or rebuild our results in bulk, or resell them as your own data service without a written agreement with us;
• get around limits, for example by rotating IP addresses, installs or keys;
• deliberately send personal information about yourself or others (we try to remove it, but please don't send it), or pages from sites we say we don't check;
• attack, overload, probe or reverse engineer the service, or use it for anything unlawful.

We may slow down, suspend or end access that breaks these terms or puts the service at risk.

6. Your content and ours

You keep any rights you have in what you send us (product details, brand names). You give us permission to process it to provide the service, and to use feedback you give us to improve it, as described in the privacy policy. The service, the BuyWise name and logo and our results belong to us or our licensors. You may use the results you get for your own shopping and, under the API, in your own app with attribution to BuyWise where practical.

7. Disclaimers

The service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, and any warranty that signals are accurate, complete or current or that the service will be uninterrupted or error-free.

8. Limits on liability

To the extent the law allows, we aren't liable for indirect, incidental, special or consequential losses, or for purchases you make or don't make based on the service. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim and $50. These limits don't apply to liability for fraud, gross negligence or willful misconduct, or to any other liability the law doesn't allow us to limit.

9. Changes and ending

We may change these terms. We'll update the date above and, for significant changes, email Pro subscribers before they take effect, with how to cancel. If you keep using the service after a change takes effect, the new terms apply; if you don't agree, stop using the service and cancel Pro. You can stop using the service anytime. We may stop offering the service or any part of it; if we end Pro, we'll refund any unused part of a month you've already paid for.

10. Law and disputes

These terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts in King County, Washington, and you and we agree to their jurisdiction, except that either of us may bring an individual claim in a small claims court where you live. If a court finds any part of these terms unenforceable, the rest stays in effect. Nothing here limits rights you have as a consumer that can't be waived under the law where you live.
